1. Service Description

BigBoard ("Service," "we," "us") is a cloud-based sports dashboard platform operated by BIG BOARD LIVE LLC. The Service is designed for commercial venues including bars, restaurants, and entertainment establishments. The Service provides real-time sports scores, game insights, and customizable branding for display on venue-owned screens for informational and entertainment purposes only. BigBoard is a data visualization tool for entertainment purposes only and does not facilitate, encourage, or provide a platform for real-money transactions.

2. Entertainment Use Only

BigBoard is a data visualization and entertainment platform. You acknowledge and agree that:

• The Service is a data visualization tool for entertainment purposes only and does not facilitate, encourage, or provide a platform for real-money transactions of any kind.
• You will not use the Service for any unlawful purpose.
• You are solely responsible for ensuring that the display of sports data within your venue complies with all applicable local, state, and federal laws and regulations.

3. Account Terms

To access the Service, you must create an account using a valid email address. Authentication is handled through secure, one-time login codes. You are responsible for all activity that occurs under your account. You must be at least 18 years old to use the Service.

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or third parties, or is otherwise objectionable. This includes, but is not limited to, non-payment, abuse of the Service, or any activity that may expose BIG BOARD LIVE LLC to legal liability.

4. Acceptable Use & On-Premises License

The Service is licensed for on-premises commercial display at your registered venue(s). You agree not to redistribute or sublicense sports data to third parties or use automated tools to scrape data from the Service.

5. Intellectual Property

All rights, title, and interest in and to the Service, including its software, design, branding, logos, and documentation, are and shall remain the exclusive property of BIG BOARD LIVE LLC. Nothing in these Terms grants you any right, title, or interest in the Service other than a limited, revocable, non-exclusive, non-transferable license to use it in accordance with these Terms.

6. User-Uploaded Content

The Service allows you to upload media (images, logos, and other files) for display on your dashboard. By uploading content, you:

• Represent and warrant that you own or have the necessary rights and licenses to use and display the content.
• Grant BIG BOARD LIVE LLC a non-exclusive, royalty-free, worldwide license to host, store, and display the content solely for the purpose of providing the Service to you.
• Agree that you are solely responsible for ensuring the content does not infringe on any third-party intellectual property rights, violate any law, or contain obscene, defamatory, or otherwise objectionable material.

We may remove any content that we determine, in our sole discretion, violates these Terms or is otherwise inappropriate. This license terminates when you delete the content or your account is terminated.

7. Subscription and Billing

Payments are processed by our third-party payment provider, Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for all transactions. By purchasing a subscription, you also agree to Paddle's Terms of Use and Privacy Policy.

Subscriptions renew automatically at the end of each billing cycle unless canceled. Cancellation takes effect at the end of the current billing period.

Refund Policy

All purchases are backed by a 14-day money-back guarantee. You may request a full refund within 14 days of any purchase or renewal date, for any reason, no questions asked. This applies to all plans, including monthly subscriptions, annual subscriptions, and one-time lifetime purchases. There are no exceptions or conditions. To request a refund, email [email protected] with your account email. Refunds are processed by Paddle (our Merchant of Record) and typically appear within 5-10 business days. Service Continuity & Lifetime Plans. All subscriptions, including lifetime plans, are valid only for as long as BIG BOARD LIVE LLC remains in good standing as a business entity and continues to operate the servers necessary to deliver the Service. A "lifetime" subscription refers to the operational lifetime of the Service, not the lifetime of the subscriber. In the event that the company ceases operations, dissolves, or permanently discontinues the Service for any reason, all subscriptions (including lifetime plans) will terminate.

8. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, server failures, or circumstances beyond our control. We shall not be liable for any damages resulting from service interruptions or downtime.

9. Third-Party Data Disclaimer

Sports scores and statistical data are sourced from third-party providers. Data is provided "as is." We do not guarantee the accuracy, completeness, or timeliness of any data. BigBoard is not responsible for any losses resulting from data delays or inaccuracies.

10. Indemnification (Your Liability)

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless BIG BOARD LIVE LLC and its officers from and against any claims, damages, or losses (including legal fees) arising out of:

• Your use of the Service in your commercial venue.
• Content you upload to or display through the Service.
• Any disputes between you and your patrons/customers regarding data displayed on the Service.
• Your violation of any applicable laws or regulations.

11. Limitation of Liability

Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential damages.

12. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Hudson County, New Jersey. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against BIG BOARD LIVE LLC.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

13. Governing Law & Venue

These Terms shall be governed by the laws of the State of New Jersey, without regard to its conflict of laws provisions. For any matters not subject to arbitration, any legal action shall be filed exclusively in the courts located in Hudson County, New Jersey.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and cancel your subscription.
